Negotiations between Vietnam and Mongolia on extradition

PSNews–Under the decision of the State President and the authority of the Prime Minister, the Ministry of Public Security (MPS) of Vietnam in coordination with the Supreme People’s Court, the Supreme People’s Procuracy, the Ministry of Foreign Affairs and the Ministry of Justice negotiated with the authorized agency of Mongolia about a bilateral agreement on extradition.

The negotiation delegation of Vietnam was led by Lieutenant General Nguyen Ngoc Anh, MPS’s Director of the Department of Legal Affairs and Administrative, Judicial Reforms while the Mongolian delegation was led by Ms. Bat-Ulzii Tumurbaatar, Director of the Legal Reform Policy Department under the Ministry of Justice and Internal Affairs of Mongolia.

The negotiation was carried out under the negotiation plan approved by the PM and agreed by the State President, following principles articulated in the Vietnam’s 2015 Criminal Procedure Code, 2016 Law on International Treaties, 2007 Judicial Assistance Law and other relevant legal documents, and conforming to the multilateral and bilateral treaties and agreements that Vietnam is a member of in the same field, while seeking a high harmony between the Vietnamese and Mongolian laws.

After the negotiation, the heads of the two delegations signed a Memorandum of Understanding and a draft agreement. Both emphasized that they would report to the competent authorities of the two countries to complete the domestic legal procedures and make necessary preparations for the signing of the Agreement in the near future.

The signing of the Agreement will also contribute to the implementation of Vietnam's commitments of the multilateral international treaties which both countries are members of such as the INTERPOL, the UN Convention against Transnational Organized Crime, the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and other multilateral treaties on crime prevention and control.

In particular, this agreement will strengthen and improve the legal basis for the two countries' competent agencies to implement extradition, while ensuring that crimes must be strictly punished on the basis of respecting the laws, legitimate rights and interests of the agencies, organizations and citizens of the two countries, thereby contributing to improving the effectiveness of crime prevention and control, as well as strengthening the traditional friendship and cooperation between the two countries, especially in the context that the two countries are preparing the 65th anniversary of the establishment of diplomatic relations in 2019.
