President’s order to promulgate nine laws announced

The Presidential Office held a press conference in Hanoi on December 11 to announce the President’s order to promulgate nine laws which were adopted at the sixth session of the 14th National Assembly.

They include the Law on corruption prevention and combat, the Law on protection of State secrets, the Law on amnesty, the Law on public security, the Law on Vietnam coast guard, the Law on amending and supplementing some articles of 37 laws related to planning, the Law on tertiary education, the Law on cultivation, and the Law on animal husbandry.

With 10 chapters and 96 articles, the Law on corruption prevention and combat stipulates the expansion of anti-corruption activities to the non-State sector.

An exclusive chapter was included to specify and promote the role of the leaders in agencies, organisations and units in the anti-corruption effort.

The law will come into force from July 1, 2019.

The Law on protection of State secrets will take effect from July 1, 2020, with five chapters and 28 articles.

A progressive provision of the law is stipulating the term of the protection of State secrets from 10 to 30 years to ensure the citizens’ right of accessing information.

The Law on amnesty will be enacted from July 1, 2019. It consists of six chapters with 39 articles stipulating the procedures of implementing amnesty as well as requirements of those who are offered pardon and the rights and obligations of amnesty recipients.

The law also prescribes the provision of amnesty in special cases and the responsibilities of agencies and organisations in the field.

The Law on Vietnam coast guard defines the role and position of Vietnamese coast guards as the people’s armed forces and specialised forces of the State, playing the core role in enforcing laws, protecting national security, and maintaining order and safety at sea.

It also stipulates the functions of Vietnamese coast guards, including the consultation of the Minister of Defence on the promulgation of policies and laws on national security protection and maintenance of maritime order and safety; and the protection of national sovereignty, sovereign rights and jurisdiction in Vietnamese waters. 

The law also prescribes seven groups of tasks and 19 powers of Vietnamese coast guards, international cooperation, and coordination activities.

It will come into force from July 1, 2019, with eight chapters and 41 articles.
